Court Procedure for Recognition in Germany
The entire procedure follows German enforcement law (Zwangsvollstreckung) in the German Code of Civil Procedure (Zivilprozessordnung - hereinafter called ZPO).
The principles for the formal recognition under German enforcement legislation are roughly similar to the criteria that are valid in the "Uniform Foreign Money Recognition Act" of the United States.
U.S. judgments are recognized and enforced according to the German Code of Civil Procedure (Zivilprozessordnung - ZPO). Legal preconditions are outlined in para 328 and 723 ZPO. The action must be filed before the local courts depending on the enforceable amount. In cases of amounts higher than 5,000.- € the regional superior courts (Landgericht) have jurisdiction.
